Misclassification of Ettain Group’s IT Professionals

Representing IT workers misclassified as contractors by Community Health Systems

If you are an IT professional employed by Ettain Group, and doing work at a Community Health System (CHS) facility, you may have been denied your rightful compensation. What is worker misclassification?

There is a significant difference between an “employee” and an “independent contractor.” As an employee, you are entitled to additional perks, “such as the minimum wage, overtime compensation, family and medical leave, unemployment insurance, and safe workplaces,” per the Department of Labor (DOL). Employees are protected by the FLSA, and the Wage & Hour Division of the DOL classifies most workers as employees, because they fulfill the requirements of an “employment relationship.”

Independent contractors, on the other hand, are “self-employed.” Generally speaking, as an independent contractor, you should be responsible for your own taxes, and should receive a 1099 as opposed to a W2. Independent contractors have more autonomy over their work, often designating where they will work (from home or from a specific facility), what days and hours they are available, and what falls into the scope of their assignments per their contracts.

IT professionals working for CHS may have been misclassified as contractors

Ettain Group hires IT professionals, then places them at CHS hospitals to build and install various healthcare software programs, and to train hospital employees on the use of the software. The IT professionals are considered employees of Ettain, but independent contractors of CHS. The Gilbert Firm’s position is that these professionals are misclassified as independent contractors because CHS controls all aspects of their work. Therefore, we argue that both Ettain and CHS may be responsible for unpaid wages which may be owed to IT professionals.

FLSA violations related to Ettain’s IT employees

Based on the DOL’s definition of “employee” vs. “contractor,” IT workers employed by Ettain, who work at CHS facilities, may have had their rights to compensation violated in two ways:

Uncompensated travel time. Workers are required to travel to hospitals in different states, often by plane, and are only paid for a few hours of travel, regardless how long it takes. These workers may be owed additional pay for travel time.
Off-the-clock and under-reported hours. Employees who work off-the-clock, or during non-standard work hours, should be compensated with overtime pay. If the companies know that their employees are working off-the-clock, and are failing to pay them for this time, they are in violation of the FLSA.

Class eligibility

To be eligible to join the class, you must have been:

Employed by Ettain Group
Classified as an independent contractor for CHS
Denied compensation for any overtime hours – anything over 40 hours in a weekly pay period – you worked

In general, FLSA violations have a statute of limitations of two years, but in some cases, you may be able to file a claim within three years of your employment. If you are or were employed by Ettain Group, and classified as an independent contractor by CHS, you might qualify to be a member of this class. Federal law prohibits any retaliation against you for exercising your rights.

The litigation is still pending

The allegations made by GMSB have not been decided by a court. The Firm cannot guarantee any particular outcome, nor that you will be granted additional compensation for any overtime hours you worked.

GMSB has taken this case on a contingency fee basis. The Firm may be entitled to receive attorneys’ fees and costs from Ettain/CHS should there be a recovery or judgment in favor of the Plaintiffs. If there is a recovery, GMSB will receive a part of any settlement obtained or money judgment entered in favor of all members of the class, or their fees will be paid separately by CHS/Ettain. If there is no recovery or judgment in Plaintiffs’ favor, GMSB will not seek any attorneys’ fees or costs from any of the Plaintiffs.
